JASON Learning recognizes the importance of maintaining the privacy of users of its websites. This Privacy Policy sets forth the privacy practices of JASON Learning websites, including our publicly-accessible websites and our other gated websites and Internet-accessible applications (the Site). Below we describe why we gather personally identifiable information, when we collect it, how we use it, with whom we disclose it, and how we protect it.

PRIVACY CERTIFICATIONS: 

Protecting Children’s and student’s privacy is especially important to us. We participate in the iKeepSafe Safe Harbor program. We have been granted the iKeepSafe COPPA Safe Harbor and FERPA seals signifying that JASON Learning has been reviewed and approved for having policies and practices surrounding the collection, use, maintenance and disclosure of personal information from Children consistent with the iKeepSafe COPPA Safe Harbor and FERPA program guidelines. Why do we gather personally identifiable information?

We may collect information that identifies you (“personally identifiable information”). For example, we may collect name and email address (or other external identifier if single-sign-on) to facilitate the functions and security of the Site.  We also may collect other identifiers, such as address, phone number, areas of specialization, and school, from Teachers and Customers to allow us to process your product orders, inform you of JASON updates and offers, and provide you with information about your usage of our Site.

When do we gather personally identifiable information?

We collect personally identifiable information at JASON Learning purchase check-outs in order to fulfill your orders, on information request forms you might optionally fill out, at the registration for the Site, and on JASON Learning surveys. We may also collect personally identifiable information in connection with your submissions for other JASON events and activities, such as optional application submissions to JASON’s Argonaut expedition program.

JASON Learning Online Store provides forms for ordering JASON Learning educational products, services and other merchandise. These forms require users to provide us with contact information (including name, address, phone number and email address). We also ask for billing information, such as credit card number and expiration date.

The gated parts of the Site are maintained by JASON Learning. They provide access to a dynamic online platform providing tools and curricular resources for educational purposes. Student responses to engagement tools such as Teacher-assigned journal entries, assessments, and interactive games and other assignments may be contained in the JASON Learning Site.

Educators/staff may create individual Site accounts for themselves and/or for their students. Students may also create their own accounts to access material that relates to subjects learned in the classroom. Sometimes registration is achieved via a single-sign-on (SSO) approach, allowing access to the Site based on a user’s Google, Microsoft, or other existing login account. We typically collect at least first and last name and email (or other ID for single-sign-on purposes). For certain situations for teachers, we might also collect postal address, school name, and phone number, if you choose to provide it. If you are a teacher, we also may ask for information about your area of expertise and role at the school.

Please note that, as a teacher, you may be subject to policies in your school or district regarding student access to and use of the Internet. Please consult your school or district policies and make sure you have the appropriate parental permission before creating Site accounts for your students.

If you are using the service as an Educational Institution, Student information may be visible during Customer Support and/or Troubleshooting.   Personally identifiable information such as Student Name, Student Email Address, file names, creation dates of files, login dates and times, and third party applications which students use could be viewed on our service by Product Support Staff.

What other information do we gather?

Cookies: A “cookie” is a small file stored on your computer by a website that stores certain information about your activity on a website. We use cookies to let us know that you are a prior visitor to our website and to provide certain features to you, for example to store information on your product selections as you shop at JASON Learning Online Store. We do not store any personally identifiable information or financial information in cookies. We use session cookies to “remember” you from request to request on our site to provide you with a personalized site experience.

Most Web browsers automatically accept cookies, but most allow you to instruct your browser to prevent the use of cookies. However, if you disable this function, certain features of the Site, such as the shopping basket and access to the Site, may not function properly.

Internet Protocol (IP) Addresses: When you visit our Site, we automatically collect and analyze certain information about your computer. This information includes the IP address used to connect your computer to the Internet. We use this IP address to help diagnose issues with end-user access to our Site, to analyze aggregated, non-personal aspects of site usage (such as the number/percentage of pages accessed from a given area), and to otherwise administer our Site. We do not permanently retain information related to IP addresses and periodically delete usage logs.

Information about your Web Browser: When you use our website, we have access to information about the type and version of browser you are using and your computer’s operating system. We use this information to determine whether your computer can view certain functions of our websites. This browser information is also captured on comment or help forms submitted to assist us in providing technical support.

How do Students gain access and how can they communicate in the Site?

Student access is gained through the Teacher or other arrangements based on the Customer order. For example, a Teacher could provide their “Student Key” to their Students to allow them to register. As another example, a school district could have their students access the Site via single-sign-on with an already-existing school-provided account (like their school-provided Google login).

Student communication within the Site is with the Teacher.

How do we use the personally identifiable information we collect from you?

JASON Learning uses personally identifiable information to process your orders; deliver the products and services you request; help us administer and evaluate JASON Learning educational program; communicate with you about events and online features that we hope you find of interest; notify you about offers and discounts from JASON Learning Online Store; and as otherwise described to you at the time of collection.

With whom do we share your personally identifiable information?

We may share or store your personally identifiable information with third-parties that perform certain functions on our behalf. These functions include providing technology services to power our Site (virtual servers, content-distribution-networks, database services, etc.), processing credit card orders from JASON Learning Online Store, assisting us in maintaining and managing our customer information, providing customer service and marketing assistance, performing business and sales analysis, and supporting features offered through our websites. We do not authorize any of these third parties to make any other use of your information. At the bottom of this document is a list of Third-Party Subprocessors.

In addition, we may share your personally identifiable information:

…In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law.

…When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing. in connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale.

We also may share aggregated information we collect with third parties. For example, we may tell our partners the number of visitors to our website and the most popular features or services accessed. This information does not contain any personally identifiable information and may be used to develop website content and services that we hope you will find of interest.

Message Boards and Chat Rooms

The Site may make message boards, and public communities available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personally identifiable information. Your personally identifiable information, such as your school address and personal email address, is not available to other users of the Site unless you choose to share them in public message boards or chat rooms.

We want you to be aware that when you click on links that take you to third-party websites, you will be subject to the third parties privacy policies, not ours. We cannot be responsible for the actions of third parties. We encourage you to read the posted privacy statement and user terms and conditions whenever interacting with, and prior to providing any personally identifiable information to, any other website or online service.

Your Security

We take steps to protect the personally identifiable information you provide us. For example, only authorized employees are permitted to access personally identifiable information and they may do so only for permitted business functions. In addition, we (or our 3rd-party payment processor) encrypt your credit card number or other other financial account information prior to transmitting it over the Internet using secure socket layer (SSL) encryption technology.

Data Breach Response

If JASON Learning becomes aware of a systems security breach by an unauthorized party or that any user data was used for an unauthorized purpose, we will comply with relevant state and other data breach laws. We will notify users of any breach resulting in unauthorized release of data electronically, at minimum, and without unreasonable delay so that you can take appropriate steps. The notification will include: date of the breach, the types of information that were subject to the breach, general description of what occurred, and steps JASON Learning is taking to address the breach.

Your Consent and Changes to this Policy

We may revise our Privacy Policy from time to time. You can see when the last update was by looking at the “Last Updated” date on this page. We won’t reduce your rights under this Privacy Policy without your explicit consent. If we make any significant changes, we’ll provide prominent notice by posting a notice on the Service,  the JASON Learning Website and notifying you by email (using the email address you provided), so you can review and make sure you know about them in advance.

In addition, if we ever make significant changes to the types of Personal Information we collect from Children, or how we use it, we will notify Parents in order to obtain parental consent or notice for those new practices, and provide Schools with the necessary information about these changes where they have obtained the appropriate permissions and are acting as the parent’s agent.

We encourage you to review this Privacy Policy from time to time, to stay informed about our collection, use, and disclosure of personal information through the Service and JASON Learning Website. If you don’t agree with any changes to the Privacy Policy, you may terminate your account. By continuing to use the Service or the JASON Learning Website after the revised Privacy Policy has become effective, you acknowledge that you accept and agree to the current version of the Privacy Policy.

Parental consent for Student usage, if required, is to be obtained by the Teacher or Customer (school system) as needed.  If the access provided to the Student is from a parent/guardian’s direct order of a JASON subscription, the providing of access key or other means of providing an account to the Student is considered consent.

Data Retention & Requests for Removal of Data

JASON periodically securely deletes personal data in our databases, typically deleting personal data when there has been no active subscription/renewal for 18 months. This time period may, however, vary as needed to fulfill the purposes for which the information was collected.

To request the removal of personal data from our Site, the Customer should contact JASON Learning in writing using the contact information provided in this policy.  

If you are the Parent of a Child who is using the JASON Site and they are participating at the direction of their Teacher under school consent (you did not give consent directly to JASON, but the Teacher or school system obtained your consent or acted as your agent and consented on your behalf), please contact the appropriate official at your Child’s School to access, review, correct or delete any of your Child’s Personal Information in the Service. If the School determines that the request should be implemented, the School may either make the change themselves or submit the request to JASON by contacting us as described in the “How to Contact Us” section below.

If you are the Parent of a Child who is using JASON and have also given parental consent directly to JASON, you may access, review, correct, or delete any of your Child’s Personal Information in the Service by contacting us as described in the “How to Contact Us” section below. Any content uploaded, however, that is shared as part of a class at a School is retained at the direction of the School (e.g., for legal compliance reasons such as maintenance of “education records” under FERPA); to correct or delete this content, please contact the appropriate official at your Child’s School. If the School determines that the request should be implemented, the School may either make the change themselves or submit the request to JASON by contacting us as described in the “How to Contact Us” section below. Additionally, at any time, you can refuse to permit us to collect further Personal Information from your Child, and can request that we delete the Personal Information we have collected from your Child by contacting us as described in the Contacting Artsonia section below.

For either method described above, we will use commercially reasonable efforts to process such requests in a timely manner consistent with applicable law. We will need to verify your identity, for example by requiring that you provide acceptable forms of personal identification.

Change of Control

Over time, JASON Learning may grow and reorganize. We may share your information, including personal information with affiliates such as a parent company, subsidiaries, joint venture partners or other companies that we control or that are under common control with us, in which case we will require those companies to agree to use your personal information in a way that is consistent with this Privacy Policy.

In the event of a change to our organizations such that all or a portion of Jason Learning or its assets are acquired by or merged with a third-party, or in any other situation where personal information that we have collected from users would be one of the assets transferred to or acquired by that third-party, this Privacy Policy will continue to apply to your information, and any acquirer would only be able to handle your personal information as per this policy (unless you give consent to a new policy). We will provide you with notice of an acquisition within thirty (30) days following the completion of such a transaction, by posting on our homepage and by email to your email address that you provided to us. If you do not consent to the use of your personal information by such a successor company, subject to applicable law, you may request its deletion from the company.

In the unlikely event that JASON Learning goes out of business, or files for bankruptcy, we will protect your personal information, and will not sell it to any third-party.

Amazon Web Services (AWS) for providing servers, databases and network infrastructure for storage, service delivery and other related services. Specific services include but are not necessarily limited to virtual machines, databases, and storage and caching services. All types of website content and traffic data is hosted and stored on these services. All personal data written to disk is encrypted.

Google for service and support for Teachers and Customers. For example, Google Shared Drives in JASON’s Google Workspaces account are used by JASON staff to perform order fulfillment tracking and educator professional development tracking.

Hubspot for customer service and support for Teachers and Customers.

Microsoft Azure for providing servers, databases and network infrastructure for storage, service delivery and other related services.
